These Terms of Service govern your access to and use of the DenIA Labs platform and website operated by DenIA Labs LLC. By accessing or using our services, you agree to these Terms.

1. Description of Service

DenIA Labs provides an AI-powered automation platform for independent Life & Health insurance producers. Services include AI lead scoring, automated bilingual follow-up, appointment automation, compliant message drafting, social media automation, and bookkeeping sync.

2. Eligibility

You must be at least 18 years of age and a licensed insurance producer (or authorized agent) to use the DenIA Labs platform. Use is subject to compliance with all applicable state and federal insurance regulations.

3. SMS Terms

By providing your phone number and opting in to SMS communications from DenIA Labs LLC, you agree to the following:

Program: DenIA Labs Beta Access & Platform Notifications
Message types: Beta access updates, platform announcements, account notifications, and service information.
Message frequency varies based on account activity and platform events.
Msg & data rates may apply. Contact your carrier for details.
Opt-out: Reply STOP at any time. You'll receive a confirmation message and no further SMS will be sent.
Help: Reply HELP or contact conect@denialabs.ai.
No sharing: Your opt-in consent and phone number will not be sold or shared with third parties for marketing purposes.
Carriers: AT&T, Verizon, T-Mobile, and others. Carrier is not liable for delayed or undelivered messages.

4. Compliance Obligations

Users are solely responsible for ensuring their use of AI-generated content, outreach messages, and automated workflows complies with all applicable laws, including TCPA, CAN-SPAM, and applicable state Department of Insurance rules and NAIC guidelines.

DenIA Labs provides tools to assist with compliance but does not provide legal advice. AI-generated drafts must be reviewed by a licensed professional before use.

5. Prohibited Use

Using the platform for unlicensed insurance solicitation
Sending unsolicited communications in violation of TCPA or applicable state law
Misrepresenting insurance products or coverage terms
Reverse engineering or extracting proprietary AI models or workflows

6. Intellectual Property

All platform content, software, brand assets, and AI models are the exclusive property of DenIA Labs LLC. No license is granted except as expressly stated in your subscription agreement.

7. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind, express or implied. DenIA Labs does not warrant that the service will be uninterrupted, error-free, or free of security vulnerabilities.

8. Limitation of Liability

To the maximum extent permitted by law, DenIA Labs LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from use of or inability to use the platform, including damages related to regulatory fines, E&O claims, or lost commissions.

9. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Texas.

10. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
